Acceptance of the Terms

2. Content and Transactions: Foovs does not guarantee:
   • The quality, legality, or safety of goods or services listed.
   • The accuracy or reliability of user-provided information.
   • The ability of buyers or sellers to complete transactions.
3. User Responsibility: You are solely responsible for:
   • Verifying goods or services before making a payment.
   • Ensuring your safety by meeting in public places during daylight hours.
   • Conducting due diligence before engaging with users for transactions or job interviews.
4. Limited Liability: We are not responsible for disputes, interactions, or transactions between users or any damages arising from such interactions.

Account Registration

To access certain features, you may need to create an account (“Account”) on the Platform. By registering, you agree to:

1. Provide accurate and up-to-date information.
2. Maintain the confidentiality of your account credentials.
3. Be solely responsible for all activities conducted through your account.

Users under the age of 18 must have the permission and supervision of a parent or guardian. We reserve the right to suspend or terminate accounts found to violate these Terms or engage in fraudulent activities.

Platform Usage

The Platform enables users to:

• Post and view advertisements for goods and services.
• Communicate directly with other users.

Foovs is not a party to transactions between users and does not act as an importer, manufacturer, distributor, or marketer of goods or services listed on the Platform.

User Responsibilities:

• Comply with applicable laws and taxation requirements.
• Provide accurate and complete details in listings.
• Respond promptly to inquiries and ensure contact details are valid.

We reserve the right to:

• Remove or block content violating these Terms or applicable laws.
• Make changes to the Service, including paid features, at any time.

Fees and Payments

Foovs is generally free to use; however, certain features may incur fees, including advertising or category-specific posting limits. Fees are:

1. Non-refundable unless otherwise stated by law.
2. Subject to change at our discretion.

User Representations and Warranties

By using the Platform, you represent and warrant that:

1. You have legal capacity to agree to these Terms.
2. You will not use the Platform for illegal purposes or to post prohibited items.
3. Your content complies with all applicable laws and does not infringe on third-party rights.
4. You will notify us of unauthorized access to your account immediately.

Prohibited content includes, but is not limited to:

• False or misleading information.
• Pornographic or violent material.
• Counterfeit goods or unauthorized copies.
• Links or references to competing platforms.

Indemnity

You agree to indemnify and hold Foovs, its affiliates, employees, and representatives harmless from any claims, damages, or liabilities arising from:

1. Your use of the Platform.
2. Violations of these Terms or applicable laws.
3. Disputes resulting from transactions with other users.

Limitation of Liability

Foovs is not liable for:

1. Indirect, incidental, or consequential damages resulting from your use of the Platform.
2. Damages exceeding the amount you paid to us in the six months preceding the claim or ₦37,000, whichever is lower.

Intellectual Property Rights

All user-submitted content remains your property. However, by posting on the Platform, you grant Foovs a non-exclusive, worldwide license to use, modify, and distribute your content for service delivery and promotional purposes.

The Platform’s design, software, and trademarks belong to Foovs and may not be used without explicit permission.

Reporting Intellectual Property Infringements

If you believe your intellectual property rights are being infringed, contact us at support@foovs.com with:

1. A detailed description of the infringement.
2. Evidence of ownership or authorization.
3. Your contact information.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes shall be resolved through arbitration under the Arbitration and Conciliation Act, with proceedings conducted in Lagos, Nigeria, in English.
